Open Burning Laws

LEARN BEFORE YOU BURN: According to KY Title 401 KAR 63:005, some open burning is  legal,  with  restrictions. But most  materials  are  actually illegal to burn. The  Division  for  Air  Quality  can  impose fines of up to $25,000 per day per violation  of  the  law.  It pays to learn before you burn!

SERIOUS HEALTH RISK:  Today‚Äôs trash is different; plastics, chemicals, and numerous other  synthetic  materials  are  far  more  common  in  the  stuff we  throw  away.  Burning  this  trash  releases  high  levels  of toxic  pollutants  such  as  dioxins,  sulfur  dioxide,  lead,  and  mercury. Children and the elderly are especially sensitive to the air pollution from open burning.During fire seasons, it is illegal to burn anything within 150 feet of any woodland or brushland between the hours of 6 a.m. to 6 p.m.

CALL BEFORE YOU BURN:  Anytime you burn, you must notify Pendleton County Dispatch Center at 859.654.3300 before starting any fire in Pendleton County.  Any person wishing to burn must be able to control such a fire so as to prevent it from causing damage to property or structures not intended for burning.  Any person who has completed a burning process must notify the 911 Dispatch Center immediately upon completion.  Please see the Pendleton County Open Burning Ordinance 341.0.
